1.1 Agreement to Terms
These Terms of Use (“Terms”) govern your use of the AudioVR service provided by AudioVR, Inc. (“AudioVR,” “we,” “us,” or “our”). AudioVR is an AI-powered detective roleplay platform that creates personalized mystery experiences with dynamic voice characters using artificial intelligence and ElevenLabs voice synthesis technology.
By accessing or using our service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the service.
1.2 Description of Service
AudioVR provides an interactive entertainment platform where users solve AI-generated detective mysteries through voice conversations with AI characters.
Our service includes:
- AI-generated detective stories and mysteries
- Voice interactions with AI characters powered by ElevenLabs technology
- Cross-platform access via web and mobile applications
- User profile and progress tracking systems
- Community features for sharing and discussing mysteries
1.3 Membership and Billing
AudioVR provides access to its services through subscription plans and pay-as-you-go options. Your subscription will continue and renew automatically unless canceled prior to the renewal date.
New users may receive a 3-day free trial, after which the applicable subscription fee will be charged to your designated payment method.
To use AudioVR, you must maintain at least one valid payment method on file. You authorize us to charge any payment method associated with your account if your primary method is declined or otherwise unavailable. All subscription fees are non-refundable except where required by law.
In addition to subscriptions, users may purchase AudioVR coins, tokens, or credits to access certain features or content. All purchases of AudioVR coins, tokens, or credits are final and non-refundable, except where required by law.
1.4 Voice Data Collection and Processing
IMPORTANT VOICE DATA NOTICE: The AudioVR service requires recording and processing of your voice for the following purposes:
Voice data is used for:
- Enabling real-time conversation with AI detective characters
- Processing your spoken responses and questions during gameplay
- Improving AI character responses and story adaptation
- Enhancing voice recognition accuracy
By using AudioVR, you explicitly consent to the recording, storage, and processing of your voice data. Voice recordings are processed in real-time and may be temporarily stored for service improvement purposes. We implement appropriate security measures to protect your voice data and limit access to authorized personnel only.
You have the right to request deletion of your voice data at any time by contacting our support team. However, deletion of voice data may limit or prevent your ability to use certain features of the service.
1.5 User Accounts and Profiles
You must create an account to use AudioVR. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to create an account. Minors may use the service only under parental supervision.
AudioVR offers profile features that allow personalized experiences. Profiles may contain viewing history, preferences, and progress data. You are responsible for managing profile access and privacy settings.
1.6 Acceptable Use
You agree to use AudioVR in accordance with all applicable laws and these Terms.
You may not:
- Use the service for any unlawful or fraudulent purpose
- Attempt to reverse engineer, decompile, or modify our AI algorithms
- Record, distribute, or share AudioVR content outside the platform
- Use automated means to access the service without permission
- Interfere with other users’ enjoyment of the service
- Use offensive, harmful, or inappropriate language during voice interactions
- Attempt to circumvent subscription or payment requirements
1.7 Intellectual Property
AudioVR and its content, including AI-generated stories, character voices, and proprietary algorithms, are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for personal entertainment purposes only.
Our partnership with ElevenLabs provides voice synthesis technology under separate licensing agreements. Users may not extract, copy, or reproduce voice models or synthesis technology.
1.8 Privacy and Data Protection
Your privacy is important to us. Our collection, use, and sharing of personal information, including voice data, is governed by our Privacy Policy and Voice Data Usage Agreement, which are incorporated into these Terms by reference.
1.9 Disclaimers and Limitations of Liability
THE AUDIOVR SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDIOVR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
1.10 Arbitration Agreement
You and AudioVR agree that any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration rather than in court, except for disputes that may be brought in small claims court.
Arbitration is conducted by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in your county of residence. YOU AND AUDIOVR WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
1.11 Termination
You may cancel your subscription at any time through your account settings. We may terminate or suspend your account for violation of these Terms or for any other reason with appropriate notice as required by law.
Upon termination, your access to the service will cease, and we may delete your account data, including voice recordings, in accordance with our data retention policies.
1.12 Changes to Terms
We may modify these Terms from time to time. We will provide notice of material changes at least 30 days before they become effective. Your continued use of the service after changes become effective constitutes acceptance of the modified Terms.
1.13 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the courts of Delaware.
